Parcel Three, Tract One: All that certain tract or parcel of land on both sides of North Shenandoah Ave. with all improvements thereon, containing 13.7947 acres, more or less, as to the Western Portion and 13.6872 acres, more or less, as to the Eastern Portion and containing a total of 27.4819 acres, more or less as shown on that certain plat with metes and bound description attached of record in the aforesaid Clerk's Office as Instrument Number 070008423, and said survey is recorded as Slide No. 235-B and Slide No. 235-C. Parcel Three, Tract Two: All that certain tract of land with all improvements thereon, containing 12.9942 acres, more or less as shown on that certain plat with metes and bound description attached, said metes and bound description is of record in the aforesaid Clerk's Office as Instrument Number 070008423, and said survey is recorded as Slide No. 235-B and Slide No. 235-C. Tax Map No. 20A2-1-2A.

The above tracts known as Parcel Two, Tract One and Tract Two and Parcel Three, Tract One and Tract Two are subject to that certain Certificate of Take by the Virginia Department of Transportation (VDOT) for the improvements of Shenandoah Avenue as shown on that certain plat dated January 18, 2011, last revised February 13, 2012 prepared by Michael M. Artz, Land Surveyor and of record in the aforesaid Clerk's Office as Instrument Number 12-0007112. All funds resulting from the Certificate of Take shall be paid to the Noteholder and the successful bidder at the public auction will have no interest in the funds filed with the Certificate of Take nor take title to the Property described in the Certificate of Take.

The sale at public auction shall take place at the front door of the Warren County Circuit Court, 1 East Main Street, Front Royal, Virginia 22630 on the 10th day of June, 2013, at 11:30 a.m. EDST, the property described in such Deed of Trust as aforesaid. The Property will be offered first by individual Tracts and then as a whole, and the manner in which the highest price is bid will be accepted by the Trustee.

TERMS OF SALE: CASH: A deposit of $5,000.00 certified check or approved check for each Tract will be required at the time of sale with settlement within fifteen (15) days from the date of sale. Additional terms may be announced at the time of sale. TIME IS OF THE ESSENCE FOR THE PURCHASER.

Adjustment of current year real estate taxes will be made as of the date of sale and thereafter assumed by the purchaser. All risk of loss shall be on the successful bidder at the time such bid is accepted and the contract of sale executed. (Neither the Substitute Trustee nor any party guarantees or covenants to deliver or obtain possession of the premises for any purchaser.)

The Substitute Trustee reserves the right to reject all bids, extend the time to receive bids, withdraw the property from sale, waive or modify the deposit requirements and/or extend the period of time for settlement. Should the Substitute Trustee be unable, for any reason in his sole discretion to convey either insurable or marketable title, the successful bidder's sole remedy in law or in equity shall be the return of the deposit. Upon the refund of the deposit, the sale shall be void and of no effect.

Written notice of the Substitute Trustee's Sale as required by 55-59.1 of the 1950 Code of Virginia, as amended, has been sent to the property owner at its address appearing in the records of the Noteholder and to all parties prescribed therein.
