NOTICE OF PUBLIC HEARING
A public hearing shall be held by the Board of County Commissioners of Trumbull County on Thursday, November 7, 2019, at 7:00 p.m. at the Mathews High School Cafeteria, 4429 Warren Sharon Road, Vienna, Ohio 44473, when and where objections to or endorsement of Project No. 2-S-14, Swift Drive Sanitary Sewer Improvements Project, Metropolitan Sanitary Sewer District, referred to in a Resolution adopted by the Board of County Commissioners on October 2, 2019 and described therein will be heard by the Board.;
The project is generally described as the construction of 8" PVC sanitary sewer collection lines together with all necessary appurtenances thereto, and the location, route and termini of the project begins at the intersection of Swift Drive and Warren Sharon Road extending northerly 953 lineal feet along Swift Drive ; Thence, commencing at the Mary Ellen Drive and Swift Drive intersection extending easterly along Mary Ellen Drive 728 linear feet; Thence, commencing at the Belmar Terrace and S.R. 193 intersection extending easterly along Belmar Terrace 539 linear feet; Thence, commencing at the Roselawn Terrace and Buena Vista intersection extending westerly along Roselawn Terrace 240 linear feet; Thence, commencing at the Buena Vista and Seminole Terrace intersection extending southerly along Buena Vista 783 linear feet; Thence, commencing at the Buena Vista and Seminole Terrace intersection extending westerly along Seminole Terrace 270 linear feet.
The resolution provides that the cost of constructing the sanitary sewer collection lines not covered by grant funds be specially assessed as an assessment district against the benefited properties within the Metropolitan Sanitary Sewer District, which are described as all those properties bounding and abutting upon the project limits.
The detailed plans, specifications and estimates of cost for the project are now on file in the office of the County Sanitary Engineer, 842 Youngstown Kingsville Road, Vienna Ohio, and open to the inspection of all interested parties.
Written objections to, or endorsement of the Project, or to the cost, scope and boundaries thereof will be received by the Board of County Commissioners for a period of five (5) business days after the hearing, and no action will be taken by the Board in the matter until after such period has elapsed.

A RESOLUTION DECLARING THE NECESSITY OF CONSTRUCTING THE SWIFT DRIVE SANITARY SEWER IMPROVEMENTS PROJECT NO. 2-S-14 FOR THE METROPOLITAN SANITARY SEWER DISTRICT.
The Board of County Commissioners of Trumbull County, Ohio met in Regular Session on Wednesday, October 2, 2019, commencing at 10:30 AM in the Commissioners' Office in the County Administration Building, 160 High Street NW, Warren, Ohio with the following members present:

Commissioner Polivka offered the following preambles and resolution and moved their adoption, which motion was seconded by Commissioner Fuda.
WHEREAS, on the instructions of this Board, the County Sanitary Engineer has heretobefore prepared, or caused to be prepared, detailed plans, specifications, estimates of cost and tentative assessments and capital charges for the Project which is hereinafter referred to and which, in the opinion of this Board, it is presently necessary to construct for the Metropolitan Sanitary Sewer District in accordance with the available and approved general plan of sanitary sewer works therefore;
WHEREAS, the Project, which is designated here as No. 2-S-14, shall consist of the construction of sanitary sewers, together with all necessary appurtenances thereto in Vienna Township;
WHEREAS, such detailed plans, specifications, estimates of cost, tentative assessments and tentative capital charges for Project 2-S-14 have been filed with this Board and are hereby approved, ratified and confirmed and copies of such plans, specifications, estimates of cost, tentative assessments and tentative capital charges are on file in the office of the Sanitary Engineer of this County and are available for examination therein;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Trumbull County, State of Ohio;
Section 1. That it is necessary at this time for the purpose of preserving, protecting and promoting the public health and welfare to construct the sanitary sewers, together with all necessary appurtenances thereto, described herein above and in such detailed plans and specifications and herein before referred to as being Project 2-S-14 for the Metropolitan Sanitary Sewer District.
Section 2. That the portion of the cost of constructing Project No. 2-S-14 not covered by grant funds shall be specially assessed as an assessment district against the benefited properties and also recovered in the form of capital charges which shall be attached to the sanitary sewer bills of the benefited properties within the Metropolitan Sanitary Sewer District that are described as all those properties bounding and abutting upon the project limits, as determined by the Trumbull County Sanitary Engineer.
Section 3. That the 7th day of November, 2019, at 7:00 PM shall be and is hereby fixed, as the time at the Mathews High School Cafeteria, 4429 Warren Sharon Road, Vienna, Ohio 44473, as the place for hearing of objections to or acceptance of Project 2-S-14, to the tentative assessments and capital charges therefore or to the boundaries of the assessment district for same and as outlined below.
The project consists of construction of gravity sanitary sewers together with all necessary appurtenances thereto, and the location, route, and termini of the Project is described generally as beginning at an existing manhole located along the north side of Warren Sharon Road at the intersection with Swift Drive and extending north along the west side of Swift Drive approximately 953 linear feet to a proposed manhole; Thence, commencing at a proposed manhole at the intersection of Mary Ellen Drive and Swift Drive and extending easterly along the south side of Mary Ellen Drive approximately 728 linear feet to a proposed manhole; Thence, commencing at an existing manhole located along the east side of SR 193 at the intersection of Belmar Terrace and S. R. 193 and extending easterly along the north side Belmar Terrace approximately 539 linear feet to a proposed manhole; Thence, commencing at a proposed manhole located along the north side of Roselawn Terrace at the intersection with Buena Vista and extending westerly along the north side of Roselawn Terrace approximately 240 linear feet to a proposed manhole; Thence, commencing at a proposed manhole along the west side of Buena Vista at the intersection of Seminole Terrace and extending southerly along the west side of Buena Vista approximately 783 linear feet to a proposed manhole; Thence, commencing at a proposed manhole along the west side of Buena Vista at the intersection of Seminole Terrace and extending westerly along the south side of Seminole Terrace approximately 270 linear feet to termination at a proposed manhole; The project also includes twenty-eight 6" service connections within the public right-of-way and 13 pre-cast concrete manholes.
Section 4. That the Clerk of this Board hereby is directed to have a notice of that hearing published once a week for two consecutive weeks in a newspaper published and of general circulation in Trumbull County, the first such publication to be made at least twenty-four (24) days prior to the hearing date fixed in Section 3 hereof, and, on or before the date of the second publication of that notice, to mail a copy of the notice to every owner of property to be assessed for Project No. 2-S-14 whose address is known and such notices shall state that the property of the addressee will be assessed and also incur a sanitary sewer bill including a capital charge by this County for Project No. 2-S-14.
Section 5. That the County Sanitary Engineer hereby is authorized and directed to review any timely written objections that may be filed with this Board with respect to Project 2-S-14 and to make recommendations to this Board concerning the dispostion of any such objections.
Section 6. It is found and determined that all formal actions of this Board concerning and relating to the adoption of this resolution were so adopted in an open meeting of this Board, and that all deliberations of this Board, and any of its committees that resulted in such formal actions were in meetings open to the public, in compliance with the rates.
